#SuperSeptember Promotion Official Rules

The following terms and conditions are the official rules (“Official Rules”) that shall apply to the Alibaba.com #SuperSeptember promotional campaign (each, a “Promotion”) being run on the Alibaba website (www.alibaba.com) (“Alibaba.com”).

1. The Promotion: During the Promotion Period (see clause 2 below), Eligible Members (as defined under Clause 4) who satisfy the requirements under Clause 5 shall be entitled to enjoy the applicable Promotion. 

2. Promotion Period: The promotion begins on September 4, 2018 00:00:00 Pacific Time (PDT) and September 30, 2018 23:59:59 (PDT) (the “Promotion Period”) (unless otherwise specified)

3. Availability: This Promotion is available on the Alibaba.com website, Alibaba.com mobile site, Alibaba iPhone and Android App, as well as Android Pads.

4. Eligible Member: You must be a registered member of Alibaba.com, except that employees, officers and directors of the Promoter and their respective immediate family members, affiliated and subsidiary companies, any company involved in the Promotion, together with their agents are not eligible to enter.

5. Promotion-specific Rules:

 a) 50% off Inspection Services

Each Eligible Member that enter into a Trade Assurance order with Gold Suppliers incorporated in China during the Promotion Period can enjoy 50% off the inspection services offered by China Certification & Inspection Group Co., Ltd and Bureau Veritas Consumer Products Services Shanghai Co., Ltd.

This Promotion is available to the first 1200 orders on a first-come, first-served basis and only applies to inspections prior to the shipment of the products in mainland China (excluding Neimenggu (Inner Mongolia), QingHai, GanSu, XiZang (Tibet), XinJiang, GuiZhou, HaiNan, Heilongjiang, JiLin, ChongQing, Ningxia and Sichuan as well as such other regions which the Promotor may from time to time determine and announce on Alibaba.com);.

The initial payment for the Trade Assurance order should be made within 60 days after placing the inspection order, otherwise the inspection order will be terminated automatically.

You need to agree to the Terms and Conditions of use of Independent Third Party Inspection Services and the terms and conditions of the relevant inspection service agreement applicable to you. 

THE INSPECTION SERVICES ARE PROVIDED DIRECTLY BY THE RELEVANT INSPECTION COMPANY AND NOT BY ALIBABA.COM.

The Promotor and each of its related companies or affiliates makes no warranties or representations of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for purpose, and completeness of the inspection services provided by the third party inspection service company. Use of the 50% off Inspection is at your own risk.

b) 50% off Alibaba.com Ocean Shipping to the U.S.

Promotion Period: The promotion begins on September 4, 2018 00:00:00 Pacific Time (PDT) and ends on October 31, 2018 23:59:59 (PDT) (the “Ocean Shipping Promotion Period”).

Promotion-specific Rules:

The first 1,000 Alibaba.com ocean shipping orders placed within the Ocean Shipping Promotion Period for Trade Assurance orders with shipping addresses to the U.S. can receive a 50% discount off the final invoice prices (up to $300). Orders for both full container load and less than container load shipping orders are eligible (excluding additional service charges and other special operating charges, including but not limited to customer order revision charges, unloading of delivery at door, inspection charges, warehousing overdue fees, tariffs, and insurance charges). The discount will show up in the bill. Make sure that your supplier completes the Ocean shipping order information before 31 December , 2018 23:59:59 PST; otherwise the discounted price will not apply.

This Promotion applies to the following services:

Less than Container Load

• Pickup: Over 19,000 zip codes in China (24 Provinces)
• Origin Port: 8 ports in China (Dalian, Tianjin, Qingdao, Shanghai, Ningbo, Xiamen, Guangzhou and Shenzhen )
• Destination Port: 8 ocean ports and 65+ inland ports within the U.S.
• To Door Delivery Coverage: 35,000+ U.S. zip codes (48 states excluding Alaska and Hawaii).
• Door to Door, Door to Port, Port to Port, Port to Door.

Full Container Load

• Origin Port: 8 ports in China (Dalian, Tianjin, Qingdao, Shanghai, Ningbo, Xiamen, Guangzhou and Shenzhen).
• Destination Port: 16 ports in the US (West Coast ports: Los Angeles, Long Beach, Oakland, Seattle, Tacoma, Houston; 10 East Coast ports: New York, Savannah, Charleston, Norfolk VA, Baltimore, Jacksonville, Miami, Philadelphia, Tampa, Boston) and 14 inland ports.
• To Door Delivery Coverage: 35,000+ U.S. zip codes (48 states excluding Alaska and Hawaii).
• Port to Door, Port to Port.

The Promotor for this promotion is Shenzhen One Touch Supply Chain Service Co., Ltd, a member of the Alibaba Group incorporated in the PRC.

c）50% off Alibaba.com Air Express to the U.S.

Eligible members can get a 50% off Alibaba.com Air Express shipping fees (up to US $30) (excluding duties and taxes charged by U.S. Customs and Border Protection and other third party fees) on qualified Trade Assurance orders with shipping addresses to the U.S. Not available to FBA warehouses.

Suppliers are responsible for shipping the orders to Alibaba.com’s Shenzhen warehouse in mainland China.

Shipment containing hazardous materials will not be accepted. Shipments containing batteries (such as model PI966, PI967, PI969 & PI970) can be accepted only if the required battery certifications and supporting documents have been provided. Please contact the supplier to confirm these details with the warehouse. 

Eligible orders must have chargeable weight of less than or equal to 20kg and the packaging size shall not be smaller than 9x9x14 cm. One shipment containing multiple packages is not allowed.

No magnetic inspection service is being offered.

The Promotor receives the right to destroy the products at the expenses of the consignee (Buyer) in the following scenarios:

• The products were not able to be cleared by the U.S. Customs and Border Protection within 7 business days of initial contact due to the failure by the consignee (Buyer) to pay duties and taxes.
• The consignee (Buyer) refuses to accept the delivery after three attempts and the shipper (Supplier) fails to provide a resolution within 4 calendar days of initial inquiries from Alibaba.com warehouse.

 The Promotor for this promotion is Shenzhen One Touch Supply Chain Service Co., Ltd, a member of the Alibaba Group incorporated in the PRC.

 d) Up to $100 off loan fee with Pay Later* (available to U.S. buyers only)

*The first 1,500 customers who take a Pay Later with Kabbage business loan on Alibaba.com between September 4 and September 30, 2018 are eligible for up to $100 off the first loan fee. No minimum loan amount requirement. One-time discount (up to $100) reflected as a credit toward the first month’s loan fee. One (1) credit per customer.  If multiple loans are taken during the promotion period, the credit is applied to the first loan. Terms and conditions of the promotion may change. The promotion may be canceled at any time. This promotion is available to U.S. buyers only.

6. General Rules:
   1. By participating in this Promotion, you agree to be bound by these Official Rules.
   2. Any fraud and/or abuse of the offers awarded/ received under the Promotion (“Offers”) by you (as determined by the Promoter at its sole discretion) will result in forfeiture of your eligibility to the Offers and/or cancellation of all or part of your account(s) with the Promoter. The Promoter reserves the right to deduct the value of any Offers awarded inappropriately to you directly from your account(s) with the Promoter without prior notice and/or take legal action in such instances to recover any outstanding amounts.
   3. In the event that the Promotion is ceased or suspended by the relevant authorities or due to serious network attack or system fault, the Promotion may be terminated prematurely. Such situation shall constitute a force majeure event and the Promoter shall not be liable for any damages or claims that arise out of the event.
   4. The Promoter is not responsible for any late, lost, delayed, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by e-mail or otherwise.
   5. In the event that the Promotion becomes inoperable due to any computer network related reasons, you agree that the Promoter shall not be held liable for any damages.
   6. Time and validity of any transactions and/or your eligibility to the Offers shall be determined by the Promoter at it sole discretion based on the Promoter’s record. If there is any discrepancy between the record of transaction held by you and that held by the Promoter, the Promoter’s record shall be conclusive and binding on you.
   7. The Promoter reserves the right to amend these Official Rules as well as to vary or terminate any of the Offers upon notice. In the event of disputes, the decision of the Promoter shall be final and binding.
   8. The Promoter reserves the right and absolute discretion to cancel or revoke your right to participate in a Promotion or use any Offers, upon discovery of your violation of these Rules or your dishonest, malicious, fraudulent, unlawful or, in the opinion of the Promoter, inappropriate acts in your participation in any Promotion.

7. Conflict of Terms and Conditions:
   1. In case of any discrepancy in the content between the English and other non-English language versions of these Official Rules, the English version shall prevail.
   2. In the event that any of the terms under these Official Rules conflict with rules and/or any such related information displayed elsewhere on Alibaba.com, the terms under these Official Rules shall prevail.

8. Disclaimer: TO THE MAXIMUM EXTENT PERMITTED BY LAW, In no event will the promoter be liable to YOU for any direct, INDIRECT, special, incidental, exemplary, punitive or consequential damages (including loss of use, data, business or profits) arising out of or in connection with your participation in thIS PROMOTION, whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not Sponsor HAs been advised of the possibility of such loss or damage. 

9. Disputes: You acknowledge and agree that the Promoter or any of its affiliates shall not be responsible, and shall have no liability to it or anyone else for any dispute or claim that arises out of the your participation in the Promotion.

10. Governing Law: You agree that this Promotion is governed, interpreted and enforced by the laws of Hong Kong, without regard to its conflict of laws principles. Any and all legal actions, claims or proceedings arising out of, or in connection with this Promotion must be brought in a court of competent jurisdiction in Hong Kong.
