Notice for “7-day dispatch” Promotion

  (i) During November 18 - December, 17 2020 (PST) (“Promotion Period”), buyers must place a “Direct Order” (i.e. you need to press “start order” on the designated webpage for this Promotion on the Alibaba.com Website) for products displaying the “7-day dispatch” logo (“Products”).

 (ii) You must have successfully completed payment for the Product(s) during the Promotion Period using the following acceptable payment methods: credit card, debit card, wire transfer or Apple Pay.

 (iii) The purchased Product(s) must not be sample products.

 (iv) The supplier must have failed to dispatch the Product(s) to you within the agreed period.

 (v) You must not cancel the order in order to obtain the Refund.

 (vi) You must not change or amend the delivery address for the receipt of the Product(s) after completing payment.

 

                                                                              Terms and Conditions for the “2020 year end sale 7-day dispatch” Promotion


                                                                                                      (“Terms and Conditions”)

 

These Terms and Conditions shall apply to the “2020 year end sale 7-day dispatch” promotional event on the Alibaba.com International Website (www.alibaba.com) (“Alibaba.com Website”).

  1. The Promotion: During the Promotion Period (as defined in Clause 2), if a Buyer (as defined in Clause 5) purchases Product(s) (as defined in Clause 6) on the dedicated webpage for this Promotion (as defined in Clause 1) on the Alibaba.com Website, such Product(s) should be dispatched to the Buyer within seven (7) clear days after payment has been completed successfully. Subject to the Conditions in Clause 6, if the supplier fails to dispatch the Product(s) to the Buyer within the agreed period, the supplier will be required to pay a Refund (as defined in Clause 5) to the Buyer (“Promotion”).

 

  1. Promotion Period:This Promotion commences on November 18, 2020 00:00:00 Pacific Standard Time (PST) until December 17, 2020 23:59:59 Pacific Standard Time (PST) (the “Promotion Period”).

 

  1. Promoter: The promoter of this Promotion is com Singapore E-Commerce Private Limited, a company incorporated in Singapore with its registered office address at (“the “Promoter”).

 

  1. Availability: This Promotion is available on the Alibaba.com Website, Alibaba.com mobile site, Alibaba iPhone and Android App, as well as Android Pads.

 

  1. Eligible participant: To participate in this Promotion, you must be a registered member with a valid buyer account on the Alibaba.com Website (“Buyer”). Notwithstanding that, any person who is an employee, officer and/or director of the Promoter (including his/her immediate family members, agents, any corporate entity in which he/she is a shareholder, director and/or employee, and, such corporate entity’s affiliates and subsidiaries) shall not be eligible to participate in this Promotion.

 

  1. Promotion-specific rules:

 

     (a) Each Buyer shall adhere to the following conditions in order to be qualified to make a claim for a Refund (as defined below) under this Promotion (“Conditions”):

 

  • (i) During the Promotion Period, the Buyer must place a “Direct Order” (i.e. you need to press “start order” on the designated webpage for this Promotion on the Alibaba.com Website) for products displaying the “7-day dispatch” logo on the dedicated webpage on the Alibaba.com Website for this Promotion (“Product(s)”);

 

  • (ii) The Buyer must have successfully completed payment for the Product(s) during the Promotion Period using an Acceptable Payment Method (as defined below);

 

  • (iii) The acceptable payment method for the purchase of Product(s) under this Promotion are: credit card, debit card, wire transfer and Apple Pay (“Acceptable Payment Method”). For the avoidance of doubt, the Promoter reserves the absolute right to remove any of the Acceptable Payment Methods for this Promotion without prior notice to you;

 

  • (iv) The purchased Product(s) must not be sample products;

 

  • (v) The supplier must have failed to dispatch the Product(s) within the agreed period;

 

  • (vi) The Buyer must not cancel the order of Product(s) (i.e. the Buyer shall still want the Product(s) to be dispatched even if the dispatch date is after the agreed period);

 

  • (vii) The Buyer must not change or amend the delivery address for the receipt of the Product(s) after completing payment for the relevant order of Product(s).

 

  Upon satisfying the Conditions above, the Buyer may submit a claim for a Refund on the Alibaba.com Website.

 

    (b) Rules relating to the Refund

 

  • (i) After the Promoter has completed its internal verification process to verify whether the supplier has dispatched the Product(s) and has determined that the supplier is responsible for the late dispatch of the Product(s), the supplier shall be responsible for reimbursing the Buyer an amount of up to 10% of the total price for the order of the Product(s) (“Refund”).

 

  • (ii) Each Buyer may only apply for one (1) claim for a Refund for each purchase order of Product(s).

 

  • (iii) The Buyer shall not make any claim for a Refund where the amount is greater than the total cost of the purchase order for the Product(s).

 

  • (iv) The total amount of any Refund reimbursed to the Buyer shall be capped at a maximum of US$100 for per purchase order of Products).

 

  • (v) For the avoidance of doubt, as long as the Buyer successfully completes payment for the Product(s) before the end of the Promotion Period and the Conditions have been satisfied, the Buyer is still entitled to make a claim for a Refund (even if the timing for submitting the application for a Refund is after the end of the Promotion Period).

 

    (c) Under the following circumstances, the Promoter and/or the supplier shall not have any obligation to provide any Refund to the Buyer:

 

  • (i) Unusual custom operations: This includes but is not limited to any delay, confiscation and/or destruction of the Product(s) due to unexpected/uncommon custom declarations at the port of departure, incomplete export information, custom clearance at the port of destination, custom inspection, lack of documents or information (including declaration value) or unclear description(s) in any commercial invoices;

 

  • (ii) Reasons attributable to the recipient of the Product(s): This includes but is not limited to the need to seek further confirmation/clarification from the Buyer and/or the recipient of the Product(s) for some information during the course of shipping, any delay due to the time taken by the Buyer and/or the recipient of the Product(s) to settle any applicable tariff, levy and etc., as well as any refusal by the recipient of the Product(s) to acknowledge receipt of the Product(s);

 

  • (iii) Supplier or the recipient of the Product(s) has provided notice to discard the Product(s), or has made additional requests that are uncommon and/or unreasonable thereby causing a delay to the dispatch of the Product(s);

 

  • (iv) Any delays which are caused due to reasons not respectively within the reasonable control of the Promoter or its logistics service provider(s) (including but not limited to any force majeure events such as any earthquake, typhoon, fire, flood, war, telecommunications interruption and/or any other natural or man-made disaster(s) as well as any delay caused by health pandemics or epidemics) or any reasons attributable to the recipient of the Product(s);

 

  • (v) the Product(s) contains hazardous materials; 

 

  • (vi) Shipment which contains of batteries (such as model PI966, PI967, PI969 & PI970) shall only be accepted if the required battery certifications and supporting documents have been provided. All Buyers shall be obliged to contact the relevant suppliers, and to request the suppliers to confirm such specifications and requirements with the logistics service provider chosen by the Buyer.

 

   (d)  The Promoter (or the logistics service provider chosen by the Buyer) shall have the right to destroy any Product(s) at the sole costs and expenses of the Buyer in the following scenarios:

 

  • (i) the Product(s) (or any part thereof) failed to pass any custom clearance due to any reason attributable to the Buyer including but not limited to its failure to settle any duty and levy in relation thereto;

 

  • (ii) the recipient of the Product(s) refuses to accept delivery.

 

    General rules: 

      (a) By participating in this Promotion, you agree to be bound by these Terms and Conditions. The Promoter reserves the right to amend these Terms and Conditions as well as to vary or terminate the terms of the Promotion requirements without prior notice to you. In the event of any dispute, the decision of the Promoter shall be final and binding.

 

      (b) Any fraud and/or abuse of the offers and/or Refund awarded/received under the Promotion (“Offers”) by you (as determined by the Promoter in its sole discretion) will result in the forfeiture of your eligibility to the Offers and/or may lead to the termination of all or part of your account(s) with the Promoter. The Promoter reserves the right to deduct the value of any Offers awarded inappropriately to you directly from your account(s) with the Promoter without prior notice and/or take legal action in such instances to recover any outstanding amounts.

 

      (c) In the event that the Promotion is cancelled or suspended by any relevant authorities or due to a serious network attack or system failure or any other reasons, this Promotion may be terminated prematurely without prior notice to you. Such situation shall constitute a force majeure event and the Promoter shall not be liable for any damages or claims that arise out of the force majeure event.

 

      (d) The Promoter is not responsible for any late, lost, delayed, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by e-mail or otherwise.

 

      (e) In the event that the Promotion becomes inoperable due to any computer network related reasons, you agree that the Promoter shall not be held liable for any damages.

 

      (f) The timing and validity of any transactions and/or your eligibility to the Offers shall be determined by the Promoter at its sole discretion based on the Promoter’s own transaction records. If there is any discrepancy between the transaction records held by you and that of the Promoter, the Promoter’s records shall be conclusive and binding on you.

 

      (g) The Promoter reserves the right and absolute discretion to cancel or revoke your right to participate in the Promotion or use any Offers, upon the discovery of any violation of these Terms and Conditions by you or your dishonest, malicious, fraudulent, unlawful or, in the opinion of the Promoter, inappropriate acts in your participation in any Promotion.

 

      (h) In case of any discrepancy in the interpretation between the English and other non-English language versions of these Terms and Conditions, the English version shall prevail.

 

      (i) In the event that any of the terms in these Terms and Conditions conflict with any rules and/or any related information displayed elsewhere on the Alibaba.com Website, these Terms and Conditions shall prevail.

 

      (j) Disclaimer: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, In no event will the promoter be liable to YOU for any direct, INDIRECT, special, incidental, exemplary, punitive or consequential damages (including loss of use, LOSS OF data, LOSS OF business or profits) arising out of or in connection with your participation in thIS PROMOTION, whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not THE PROMOTER HAs been advised of the possibility of such loss or damage.

 

      (k) Notwithstanding anything to the contrary, you acknowledge and agree that the Promoter and/or any of its affiliates shall not be responsible, and shall have no liability to you or any third party for any dispute or claim that arises out of your participation in this Promotion.

 

      (l) You agree that this Promotion and these Terms and Conditions are governed, interpreted and enforced by the laws of Hong Kong, without regard to its conflict of laws or principles. Any and all legal actions, claims or proceedings arising out of, or in connection with this Promotion must be brought in a court of competent jurisdiction in Hong Kong.
